This contract is very long and thorough, please read and make sure you understand each part of it.  All purchasers should make sure they have read, fully understand each page and agree to abide by all the conditions of this contract.  Please ask any questions before purchasing the above puppy.

All purchasers should realize that there is no such thing as a 100% health guarantee for a living being such as a puppy.  Sauder’s Kennel strives very hard to raise healthy and happy puppies but as in life nothing is 100% a sure thing.  Sometimes something unforeseen and beyond Sauder’s Kennel control can crop up at anytime in the puppies life.  The breeder guarantees that your puppy was in good health to the best of their knowledge at time of vet examination of puppy at the breeders, and has had the necessary initial shots.  The purchaser agrees that the breeder would not knowingly sell them a sick puppy.  Purchaser will have 72 hours or three business days to have the puppy examined by a vet of the purchaser's choice, at the purchaser's expense.  If the puppy is found to be unhealthy with a life threatening hereditary defect that will affect the puppies day to day quality of life by the purchaser's vet the breeder will replace the puppy with another puppy of equal value or refund the purchase price to be decided by the breeder (within a six month period) with the following conditions:  puppy must be returned to the breeder at the purchaser’s expense so the breeder's vet can re-examine the puppy before the breeder agrees upon replacement puppy or refund.  It is the responsibility of the purchaser and at the expense of the purchaser to return the puppy to the breeder.  If the breeder's vet agrees with the purchaser's vet report then and only with this vet agreement the pup will be replaced as soon as a pup of equal value is available or purchase price refunded, this is to be decided by the breeder.  Refunds will be paid within a six month time period.  Breeder must receive the vet report within twenty-four hours of examination.  Purchaser must forward a copy of the 72 hour initial vet check to the breeder or the health guarantee becomes nul and void.  This must be forwarded to the breeder within 96 hours or four business days of puppy purchase from the breeder.  If breeder does not receive this report from the purchaser the breeder will assume the puppy is in good health and purchaser will be responsible for all future well being of the puppy.  

Bulldog health guarantee will not cover cherry eyes, umbilical hernias, entropian or ectroprian, stenotic nares, elongated soft palette, loose hips, allergies, demodex or inverted tails.  These are all common problems of bulldogs and the breeder feels that the purchaser should have educated themselves to this fact and be aware of all these conditions before purchase of puppy through reading a variety of bulldog related books, talking to various vets and asking various breeders.  Also the breeder will not pay for any vet bills of the purchaser and Sauder's Health Guarantee will not cover coccidia, giardia, kennel cough, worms or any type of internal or external parasite as these can be picked up after leaving the breeders.  Some can simply be brought on by the stress of the move and a new environment.

In order for this puppy health guarantee to remain in effect purchaser must have their veterinarian supply the puppy with all the necessary future vaccinations at the proper times.  Also the puppy must receive all necessary internal and external parasite treatments when recommended by purchaser's vet and any other needed and recommended treatments requested by the purchaser's veterinarian.  Puppy must be spayed or neutered between six to eight months of age.  All puppies are sold on mandatory non-breeding contracts that will be enforced if need be.  The purchaser must supply a copy to the breeder that the spay or neuter procedure was completed and this must be filled out on the purchaser’s vet’s letterhead paper and signed by their vet stating this has been done with the date the surgery was performed.  This must be forwarded to the breeder by the time the puppy is nine months of age.  Then and only then will the breeder forward any registration papers.  If this is not done health guarantee becomes void.  Court actions may be initiated by the breeder for breach of contract as well as compensation sought for court costs etc.  This is a legal and binding document and all actions quoted will be followed through with, by the breeder. 

The breeder takes breeding a litter and the placement of puppies very seriously and expects all puppy purchasers to take the purchasing of a puppy and the providing of quality life long care to the puppy just as seriously and abide by this contract, as they have agreed to at the time they purchased the puppy.

If a life threatening hereditary problem arises within three years of the puppy's birth that directly affects the quality of the puppies day to day life the breeder will replace the puppy with a puppy of equal value when available or will refund the purchase price of the puppy (to be decided by the breeder and refunds are to be paid within a six month time period), if, and only if breeder's vet receives a copy from purchaser's vet with copies of findings, any exams, x-rays, autopsy or tests performed and breeder’s vet fully agrees with purchaser's vet, then and only then will a replacement puppy or refund be discussed.  The purchaser must also have fulfilled all above requirements.  If the puppy dies for any reason that is confirmed by an autopsy by both the purchaser's vet and breeder's vet that is a hereditary genetic defect within three years of birth the breeder will refund the purchase price of the puppy(within a six month time frame) or replace the puppy with a puppy of equal value when available only if breeder's vet receives a copy of all purchaser's vet findings and autopsy must have been performed by purchaser’s vet and breeder's vet must agree with the findings of it.  Breeder will not be responsible for any of the purchaser's costs.  If this is not supplied to breeder's vet by the purchaser's vet this guarantee will be void.   In the event that the puppy's death is the result of abuse or negligent treatment this guarantee WILL NOT apply and breeder WILL NOT replace puppy and the purchaser will be reported to the proper authorities.   No puppy will be replaced because of accidental death through carelessness on the purchaser’s part, such as being ran over by a car, drowning or swallowing something when not being properly supervised etc.

Should the purchaser decide to have any non- life threatening defect of any kind repaired on the puppy at any time in the puppy's life all costs for the puppy's surgery etc will be the full financial responsibility of the purchaser.  Breeder will not be responsible for any of these expenses.  The breeder will not pay any vet bills at any time in the pup’s life unless previously arranged and agreed to in writing by the breeder and purchaser.  If the breeder agrees to pay any vet bills and this is agreed between both parties and is placed in writing and signed by both parties then the liability of the breeder will only be up to the original purchase price of the puppy.  Breeder will not pay any vet bills over the original purchase price paid for the puppy.  This is what liability of breeder means.  The purchaser will pay any vet costs above original purchase price of the puppy.

Should the purchaser decide at any time in the puppy's life to dispose of or give away the puppy for any reason what so ever, the breeder must be notified immediately and pup must be returned to the breeder.  It is at the purchaser's expense to return the puppy to the breeder.  The breeder will decide what is to happen to the puppy once returned.  The puppy "must never" under any circumstances be surrendered to any animal shelter, humane society or bulldog rescue at any time in its life.  THERE WILL BE ABSOLUTELY NO REFUND PAID FOR THE RETURNED PUPPY OR DOG SO DO NOT EXPECT IT LATER IF YOUR SITUATION CHANGES.  NO EXCEPTIONS WILL BE MADE!!!!  If any puppy is returned to the breeder the purchaser must also supply all paperwork the breeder supplied to them at time of purchase and also any registration papers that have been forwarded from the breeder to the purchaser.  The purchaser must have proof that they have kept all vaccinations and parasite treatments up to date etc, and the puppy must appear healthy, well fed and well cared for.  There should not be any signs of abuse against the puppy and the puppy should not be thin or sickly.  If any of these signs are present legal actions may be undertaken against the purchaser by the breeder for abuse.  

Temperament:  this puppy will be replaced or money refunded(to be decided by the breeder) if it is proven by the purchaser or purchaser and their trainer that this puppy's bad temperament is from bad breeding.  Purchaser must provide breeder with written information to substantiate this claim.  Purchaser must also show that the puppy has completed two full and complete separate sessions of puppy training programs, as the breeder feels that all puppies need to go to puppy school and it is in the purchaser's best interest and a good resource for future pet behavior.  The breeder also has the right to have the puppy returned to breeder at the purchaser's expense for behavior testing and vet assessment before a replacement puppy or refund will be discussed or agreed upon.  If the complete training sessions have not been completed and or the purchaser has not had a dog behavior specialist assessment performed on the puppy by a qualified individual before returning the puppy to the breeder then the puppy will not be replaced or any money refunded as the breeder feels this is irresponsible behavior on the part of the purchaser.  If the puppy has bad temperament and breeder’s vet thinks it was caused by some form of abuse by the purchaser a replacement puppy or refund will not be given to the purchaser.  Also legal action will be taken against the purchaser for animal abuse.

All health guarantees become null and void if the puppy has been bred either intentionally or unintentionally (which violates the CKC non-breeding contract) or is allowed to become severely overweight.  Also legal actions may be started in regard to violating the CKC non-breeding contract. 

There will be no guarantee as to the adult size or coloring that the puppy will mature to.  You can view the parents but sometimes something can crop up and a puppy can finish larger or smaller than anticipated by the size of parents.  There are no guarantees that the puppy is show quality or that it will win any dog shows it may be entered into.

All puppies are strictly sold as pet quality companion animals and house pets, not show or breeding stock quality animals unless other arrangements have been agreed to in writing between Sauder's Kennel and all involved parties.  Mandatory spay/neuter contracts are in place on all pet quality companion puppies.  A CKC non breed contract means you cannot breed the dog at anytime in it's life.  It does not mean you can breed the dog and just not register the puppies.

Purchaser does hereby agree to take good and reasonable care of this puppy, including but not limited to the following:
-purchaser must provide all required immunizations that become due after the time of purchase,  and any required internal and external parasite treatments as recommended by the purchaser’s vet
-clean, fresh water
-puppy should not be left outside unattended unless in a secure enclosure, and not on a permanent basis or for long periods during inclement weather conditions-too hot or too cold 

-puppy must be kept on leash at all times when in public places or out of a confined area
-puppy is not to be a full time outside dog

Puppy must be kept on TLC Whole Life Natural Dog Food for this health guarantee to remain in effect.  The breeder can check online that the purchaser is ordering and using this food so please do not purchase a puppy, change the food and tell the breeder that the purchaser is still feeding the TLC or the purchaser will void their health guarantee.  The breeder cannot force the purchaser to use this food but the breeder can and will render the health guarantee null and void if the purchaser does not abide by this contract.  The purchaser can order this food at http://www.tlcpet.com/23173 and they also supply free delivery to the purchaser's house so no more running around after dog food.

If ALL AND EVERY ONE OF the conditions above are not met by the purchaser the breeder will not be responsible to replace the puppy or refund any money.  The puppy will not be replaced nor money refunded because of urinating or defecating in the house; the breeder feels it is up to the purchaser to properly house train the puppy once it has been purchased.  A puppy is never 100% house trained at eight weeks of age.  Also the puppy will not be replaced nor money refunded if the puppy cries when confined to a crate as the breeder feels the puppy should learn to be crated or confined for its own well-being and safety while the purchaser is away.  All purchaser's need to realize that puppies will cry when they leave their mother, litter mates and first home to go to a new home.  Also they may cry when left alone or in the middle of the night.  This is all part of puppy parenthood and should not be entered into lightly or on the spur of the moment.  With love, time and much patience you will have a wonderful puppy that grows into a wonderful companion in the future but it is entirely up to the purchaser to see that these needs are fulfilled in full every day of the puppy's life.

The breeder believes that purchasing a puppy is a life long commitment and should not be entered into lightly or on the spur of the moment.  The breeder assumes the purchaser is aware of and has educated themselves to the future costs involved with the upkeep, food, vet costs, training, and that the purchaser is willing to supply these and also to supply the love, time, patience, training etc that the puppy will require for its life.  The breeder feels there should be no need for the puppy to have to be surrendered or disposed of at any time in its life if the purchaser is a responsible pet owner.  The breeder is available to answer questions and make suggestions and try to help to the best of their ability if contacted by the purchaser.

VIOLATION OF THIS CONTRACT WILL RESULT IN LEGAL ACTIONS BEING INITIATED FOR BREACH OF CONTRACT.

BREEDER WILL NOT BE RESPONSIBLE FOR ANY VT BILLS OF THE PURCHASER UNLESS PREVIOUSLY ARRANGED AND AGREED TO BETWEEN BOTH PARTIES AND PUT IN WRITING.

BREEDER'S LIABILITY WILL BE  SOLELY LIMITED TO ORIGINAL PURCHASER PRICE OF THE PUPPY/DOG.

PURCHASER MUST CARRY ON WITH PET INSURANCE AFTER THE SIX WEEK FREE TRIAL PERIOD IN ORDER TO GUARANTEE THE PUPPY RECEIVES ANY NECESSARY VET TREATMENT/SURGERY ETC IN CASE THE PURCHASER CAN NOT IMMEDIATELY AFFORD THE COST OF THESE TREATMENTS.
